ViyahVogue is a peer-to-peer South Asian occasion wear rental marketplace connecting lenders (people who list outfits for rent) and borrowers (people who hire them). We are operated by ViyahVogue Ltd, a company registered in England and Wales.
ViyahVogue provides a platform that enables members to list outfits for rent and for other members to discover and book those outfits directly. By using the platform, you confirm that you accept these Terms and Conditions and agree to comply with them.
ViyahVogue is not a party to the rental contract between lender and borrower. The rental agreement is formed directly between the lender and the borrower. ViyahVogue acts as an intermediary only.
To use ViyahVogue you must:
Be at least 18 years old
Be based in the United Kingdom
Provide accurate information at registration and keep it up to date
Hold one account only – multiple accounts are not permitted
ViyahVogue reserves the right to refuse, suspend or terminate any account at its sole discretion.
All payments are processed via Stripe. When a borrower confirms a booking, the following are charged upfront:
The rental fee for the agreed duration
The security deposit set by the lender
Payments are in GBP. ViyahVogue does not store card details.
ViyahVogue charges a 20% commission on the rental fee. Commission is deducted from the rental fee before the lender receives their earnings. Commission is not charged on the security deposit.
A security deposit is charged to the borrower at the time of booking alongside the rental fee. The deposit is held by ViyahVogue and is not released to the lender. Its purpose is to provide financial protection in the event of damage, loss or non-return.
The deposit is released back to the borrower once both the lender and the borrower have submitted their post-rental reviews, subject to clause 4.4 (Late Returns) where applicable. Deposits are not released early under any circumstances, even where the return is completed without issue.
ViyahVogue holds deposits as a neutral party. Deposit funds may be withheld or applied in the event of a damage dispute, at ViyahVogue’s discretion.
Lenders receive their earnings (rental fee minus 20% commission) after both post-rental reviews have been submitted. Payouts are processed on a monthly batch basis via Stripe Connect. Lenders must complete Stripe onboarding before any earnings can be released.
ViyahVogue reserves the right to withhold or delay payouts where a dispute is active or where the lender’s Stripe Connect account is incomplete, suspended or requires updated information at the time of payout.
If a borrower cancels a confirmed booking within 24 hours of the scheduled collection time, a £20 cancellation fee is retained by ViyahVogue. The Stripe transaction fee is also non-refundable. The remaining rental fee and the security deposit will be returned to the borrower.
Where the rental fee is less than £20, the cancellation fee will be deducted from the security deposit first. In this case the borrower will receive no rental fee refund and a reduced deposit refund.
If a borrower cancels more than 24 hours before the scheduled collection time, the rental fee (minus the Stripe transaction fee) and the security deposit will be returned to the borrower. The £20 cancellation fee does not apply.
Refunds are processed via Stripe and may take 5-10 business days to appear. No refund will include Stripe transaction fees, which are non-recoverable.
Lenders must give as much notice as possible if they need to cancel a confirmed booking. Where a lender cancels, the borrower will receive a refund of the rental fee (minus the Stripe transaction fee) and the security deposit.
Repeated lender cancellations may result in account suspension. ViyahVogue reserves the right to record a cancellation on the lender’s profile.
If a borrower does not collect the outfit at the agreed time and has not cancelled in advance, the rental fee is forfeited. The security deposit will be refunded.
If an outfit is not returned by the agreed return time, a late return fee will apply for each day it remains outstanding. The fee is calculated as the daily rental rate plus an additional 50% penalty per day (for example, a £20/day outfit returned 2 days late would incur £60 in late fees: £40 rental plus £20 penalty).
This fee is deducted from the security deposit and is capped at the full value of the deposit held. ViyahVogue cannot recover more than the deposit amount through this mechanism.
Lenders must notify ViyahVogue at operations@viyahvogue.com as soon as an outfit is confirmed late. ViyahVogue will attempt mediation between both parties for 5 working days from the date of notification. Late fees continue to accrue throughout the mediation period, up to the deposit cap.
Where the outfit remains unreturned following the mediation period, the matter will be treated as theft. ViyahVogue reserves the right to report the matter to the police and to relevant credit reference agencies.
The security deposit will not be released to the lender until ViyahVogue’s investigation into the matter has concluded.
All collections and returns must be completed in person. No proxy collections are permitted. The borrower must be present at collection.
Both parties are required to use the ViyahVogue Handover App at viyahvogue.com/handover to complete the handover process. This includes:
Confirming the items present
Recording the condition of the outfit
Confirming that photos and video evidence have been saved to the borrower’s device
ID verification for the borrower (valid passport, driving licence or national ID)
Digital signature from both parties
Lenders are responsible for carefully checking the borrower’s ID at the point of collection and must follow the ID verification steps in the Handover App. Lenders should not proceed with the handover if the borrower cannot produce a valid ID or if the ID does not match the account details. ViyahVogue cannot be held responsible for losses arising where a lender proceeds with a handover without completing ID verification.
The handover record created via the app constitutes the agreed record of condition at collection and return. In the event of a dispute, ViyahVogue will rely on this record as the primary evidence of outfit condition.
Photos or video captured while wearing the outfit will not be accepted as evidence of condition.
Lenders are responsible for:
Disclosing any pre-existing damage or wear at or before handover via the Handover App
Ensuring the outfit is clean and in a wearable condition at collection
Cleaning the outfit after each rental before it is listed or rented again
Borrowers are responsible for returning the outfit in the same condition as collected, subject to normal fair wear and tear. Normal wear and tear includes minor issues that can be resolved by cleaning, such as small marks or minor creasing.
Borrowers are responsible for loss, theft or damage beyond normal wear and tear. This includes but is not limited to stains that cannot be removed, tears, missing embellishments, or non-return of the outfit or any included items. Where an outfit is returned late, clause 4.4 applies. Where an outfit is not returned at all, this clause and clause 4.4 apply together.
Any damage must be raised by the relevant party within 48 hours of the return being completed. Disputes raised after this window may not be considered.
To raise a dispute, email operations@viyahvogue.com with:
Your booking reference
A description of the issue
Photos or video evidence of the damage (timestamped where possible)
Any receipts for cleaning or repair
Both parties should first attempt to resolve the matter directly. If no resolution is reached, ViyahVogue will review the evidence and make a determination.
ViyahVogue will review available evidence and make a reasonable determination. ViyahVogue’s decision on disputes is final. ViyahVogue is not an insurer and does not guarantee the recovery of funds from another member.
Where ViyahVogue determines that damage has occurred, it may apply the security deposit in full or in part toward the cost of cleaning or repair. Where the deposit does not cover the full cost of damage, lenders must pursue any remaining claim directly with the borrower. ViyahVogue is not liable for any shortfall.
Late returns and non-returned outfits are handled in accordance with clause 4.4, including the application of late return fees against the security deposit and, where applicable, reporting to the police and relevant credit reference agencies.
Lenders are responsible for the accuracy of their listings. By listing an outfit on ViyahVogue, lenders warrant that:
They are the legal owner of the outfit or have the right to rent it
The listing description and photographs accurately represent the outfit, including its current condition and any pre-existing wear or damage
All photographs are their own original images taken by them or on their behalf. Images taken from retailer websites, brand pages, Google Images or any other third-party source are strictly prohibited and may result in listing removal or account suspension
The outfit is clean, in a wearable condition, and will be available on the agreed dates
ViyahVogue reserves the right to remove listings that do not meet platform standards or that contain inaccurate, misleading or inappropriate content.
Members must not arrange any part of a rental transaction outside the ViyahVogue platform with the intention of reducing or avoiding ViyahVogue’s commission. This includes, but is not limited to, booking for fewer days than the actual rental period and arranging payment for the remaining days directly between lender and borrower.
ViyahVogue reserves the right to act on reasonable suspicion of fee avoidance. Reasonable suspicion may be established through platform messages, booking patterns, or reports from either party. ViyahVogue is not required to prove fee avoidance beyond reasonable doubt in order to take action.
Where fee avoidance is suspected, ViyahVogue will freeze the security deposit and any outstanding earnings pending investigation. Neither party will have access to these funds until the investigation is concluded.
Where a lender reports that an outfit has not been returned at the end of the booked period, ViyahVogue will treat this as a late return in accordance with clause 4.4. However, where platform evidence suggests that the extended rental period was part of an arrangement to avoid fees, the lender’s late return claim will be dismissed. In such cases the lender will not be entitled to recover costs from the deposit, and the deposit will be released to the borrower.
Lenders found to have engaged in fee avoidance will face account suspension. As the party responsible for paying ViyahVogue’s commission, lenders bear primary responsibility for ensuring all rental arrangements are made through the platform. The fact that a borrower benefited from a lower rental cost does not diminish the lender’s liability for the breach.
Both lenders and borrowers are required to submit a post-rental review before earnings and deposits are released. Reviews must be honest, accurate and based on the member’s genuine experience of the rental. Reviews must not be false, vindictive, retaliatory or designed to harm another member’s reputation. Manipulation of the review system, including coercion, fabrication or abuse of the review process, is a breach of these Terms.
ViyahVogue reserves the right to remove reviews that it considers to be false, vindictive or otherwise in breach of these Terms.
All members must use ViyahVogue lawfully and respectfully. You must not:
Provide false or misleading information in your listing, profile or during the handover process
Attempt to take transactions off-platform to avoid fees
Harass, threaten or abuse other members or ViyahVogue staff
Use the platform for any unlawful purpose
ViyahVogue reserves the right to suspend or terminate accounts that breach these Terms.
Platform messages sent via the ViyahVogue messaging system may be reviewed by ViyahVogue at any time and for any reason. This includes, but is not limited to, the investigation of disputes, suspected fee avoidance, or reports of inappropriate conduct. By using the platform messaging system, you consent to this.
All communication between lenders and borrowers regarding a rental must take place through the ViyahVogue platform messaging system. Communications that take place outside the platform, including via WhatsApp, SMS, email or any other channel, cannot be reviewed by ViyahVogue and will not be considered as evidence in the event of a dispute.
Members are solely responsible for declaring their earnings and paying any applicable taxes, including income tax and VAT. ViyahVogue does not provide tax advice.
Under UK law, ViyahVogue may be required to collect and report earnings data to HMRC. Lenders and sellers who earn over GBP 1,700 or complete more than 30 transactions in a tax year may be subject to mandatory HMRC reporting. ViyahVogue reserves the right to request relevant tax information from members and to withhold payouts where this information is not provided.
ViyahVogue is a marketplace platform and intermediary. We are not a party to the rental contract between lender and borrower and are not responsible for the condition, quality, fit or authenticity of any outfit listed on the platform.
To the maximum extent permitted by UK law, ViyahVogue’s liability to any member is limited to the commission fee paid in connection with the relevant booking. ViyahVogue is not liable for indirect, consequential or financial losses.
Nothing in these Terms limits ViyahVogue’s liability for death or personal injury caused by negligence, fraud or any other liability that cannot be excluded by law.
ViyahVogue does not guarantee uninterrupted access to the platform and is not liable for losses arising from downtime or technical issues.
Where ViyahVogue reports a member to the police or to a credit reference agency in good faith and in accordance with clause 4.4, ViyahVogue is not liable for any loss, damage or distress arising from that report, including where the underlying matter is later resolved or disputed.
By uploading photos or other content to ViyahVogue, you grant ViyahVogue a non-exclusive licence to use that content for the purposes of operating and promoting the platform. You retain ownership of your content.
You warrant that any content you upload is your own original material and does not infringe the rights of any third party. Listing photos must be original photographs of the outfit taken by the lender or on the lender’s behalf. Images taken from retail websites, brand pages, Google Images or any other third-party source are not permitted and may result in listing removal or account suspension.
ViyahVogue processes personal data in accordance with our Privacy Policy, available at viyahvogue.com. By using the platform you consent to this processing.
ID documents captured via the Handover App are sent directly to operations@viyahvogue.com and are not stored on the platform. They are handled in accordance with GDPR and retained only as long as necessary.
ViyahVogue may update these Terms from time to time. Where changes are material, we will notify members by email. Continued use of the platform after the effective date of any update constitutes acceptance of the revised Terms.
These Terms are governed by the laws of England and Wales. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
